K\u00ebto tekste mund t\u00eb gjenden vet\u00ebm n\u00eb FSHI \u2013 Shkup.<\/p>\n<p><strong><u>Sintaksa e gjuh\u00ebs arabe<\/u><\/strong><\/p>\n<p>L\u00ebnda e Gjuh\u00ebs Arabe \u00ebsht\u00eb nj\u00eb nd\u00ebr l\u00ebnd\u00ebt m\u00eb t\u00eb r\u00ebnd\u00ebsishme q\u00eb studiohen n\u00eb Fakultetin e Shkencave Islame &#8211; Shkup. Kjo l\u00ebnd\u00eb, sipas plan programit aktual studiohet tet\u00eb semestra, sepse t\u00eb gjitha l\u00ebnd\u00ebt tjera fetare, jan\u00eb t\u00eb Iidhura me k\u00ebt\u00eb gjuh\u00eb. Vet\u00eb fakti se Kur&#8217;ani Fam\u00eblart\u00eb dhe hadithet e Muhamedit a.s, jan\u00eb n\u00eb k\u00ebt\u00eb gjuh\u00eb, flet p\u00ebr r\u00ebnd\u00ebsin\u00eb e saj n\u00eb jet\u00ebn e \u00e7do studiuesi islam.<br \/>\nPara disa koh\u00ebve, Dekanati i Fakultetit, me p\u00eblqimin e vet\u00eb Reisit t\u00eb Bashk\u00ebsis\u00eb Fetare Islame, ngriti nj\u00eb iniciativ\u00eb p\u00ebr botimin e teksteve t\u00eb Fakultetit, andaj gjat\u00eb angazhimit ton\u00eb disavje\u00e7ar n\u00eb k\u00ebt\u00eb Fakultet, n\u00eb cil\u00ebsi t\u00eb pedagog\u00ebve t\u00eb l\u00ebnd\u00ebs| juh\u00ebs Arabe, e pam\u00eb t\u00eb arsyeshme p\u00ebrgatiljen e nj\u00eb teksti t\u00eb p\u00ebrshtatsh\u00ebm p\u00ebr student\u00ebt tan\u00eb.<br \/>\nDuke pasur parasysh q\u00eb student\u00ebt tan\u00eb nuk kan\u00eb m\u00ebsuar n\u00eb vendet arabe, dhe gjith\u00eb at\u00eb q\u00eb e din\u00eb nga kjo gjuh\u00eb jan\u00eb m\u00ebsimet q\u00eb i kari\u00eb m\u00ebsuar n\u00eb shkolli- min e mes\u00ebm, n\u00eb medrese, kemi b\u00ebr\u00eb p\u00ebrpjekje q\u00eb nj\u00ebsit\u00eb m\u00ebsimore t\u00eb jen\u00eb t\u00eb thjeshta dhe t\u00eb qarta p\u00ebr ta.<br \/>\nKy tekst, n\u00eb p\u00ebrgjith\u00ebsi, p\u00ebrfshin\u00eb sintaks\u00ebn e gjuh\u00ebs Arabe, mir\u00ebpo, bazuar n\u00eb lidhshm\u00ebrin\u00eb e konsiderueshme q\u00eb sintaksa ka me morfologjin\u00eb, kemi p\u00ebrfshir\u00eb edhe disa rregulla morfologjike apo morfosintaksore.<br \/>\nTeksti n\u00eb fjal\u00eb \u00ebsht\u00eb i ndar\u00eb n\u00eb krer\u00eb. Kreu i par\u00eb p\u00ebrfshin vler\u00ebn e gjuh\u00ebs arabe, zhvillimin dhe shkencat e saj. N\u00eb kreun e dyt\u00eb flitet p\u00ebr fjal\u00ebn, ndarjet e slj dhe ve\u00e7orit\u00eb t\u00eb \u00e7do ndarjeje. Kreu i tret\u00eb, t\u00ebr\u00ebsisht, i kushtohet sintaks\u00ebs s\u00eb foljes. N\u00eb kreun e kat\u00ebrt, shkurtimisht, u b\u00ebhet nj\u00eb qasje parafjal\u00ebve dhe pjes\u00ebzave; kurse n\u00eb kreun e pest\u00eb nis sintaksa e emrit. N\u00eb t\u00eb tregohen kategorit\u00eb e emrit: gjinia, numri, shkronja e fundit, shquarsia dhe rasa. Gjithashtu, duhet p\u00ebrmendur se ky \u00ebsht\u00eb kreu n\u00eb t\u00eb cilin, krahas rregullave sintaksore, jan\u00eb p\u00ebrfshir\u00eb edhe shum\u00eb rregulla morfologjike. Kreu i gjasht\u00eb, gjer\u00ebsisht, i kushto- het kategoris\u00eb s\u00eb shquarsis\u00eb dhe pashquarsis\u00eb; nd\u00ebrsa kreu i shtat\u00eb ka t\u00eb b\u00ebj\u00eb me m\u00ebsimet e p\u00ebrgjithshme dhe ndarjet ky\u00e7e t\u00eb kategoris\u00eb s\u00eb ras\u00ebs, sepse rasat e emrit, gjer\u00ebsisht, do t\u00eb shtjellohen n\u00eb krer\u00ebt n\u00eb vazhdim. Kreu i tet\u00eb, t\u00ebr\u00ebsisht dhe gjer\u00ebsisht, i kushtohet ras\u00ebs em\u00ebrore, i n\u00ebnti ras\u00ebs kall\u00ebzore dhe kreu i dhjet\u00eb, ras\u00ebs gjinore. N\u00eb kreun e nj\u00ebmb\u00ebdhjet\u00eb trajtohen p\u00ebrcaktor\u00ebt me p\u00ebrshtatje, kurse n\u00eb t\u00eb dymb\u00ebdhjetin, fjalit\u00eb dhe disa m\u00ebnyra apo forma t\u00eb fjalive&#8230;.<\/p>\n<p><strong><u>E drejta penale islame<\/u><\/strong><\/p>\n<p>Sheriati islam, krahas t\u00eb drejt\u00ebs Romake Kontinentale dhe t\u00eb drejt\u00ebs Anglosaksone, \u00ebsht\u00eb nj\u00ebri nga tri sistemet m\u00eb me r\u00ebnd\u00ebsi t\u00eb s\u00eb drejt\u00ebs bashk\u00ebkohore. Ai, krahas dy sistemeve tjera, sot \u00ebsht\u00eb nj\u00eb burim inspirues i t\u00eb drejt\u00ebs pozitive t\u00eb shum\u00eb vendeve bashk\u00ebkohore dhe sh\u00ebrben si mjet i moblizimit politik dhe vler\u00ebsimit t\u00eb t\u00eb drejt\u00ebs pozitive n\u00eb vendet muslimane, ngjajsh\u00ebm me konceptin e t\u00eb drejt\u00ebs natyrore n\u00eb tradit\u00ebn evropiane. Prandaj e drejta e sheriatit studiohet jo vet\u00ebm n\u00eb kuad\u00ebr t\u00eb katedr\u00ebs s\u00eb Historis\u00eb s\u00eb shtetit dhe t\u00eb drejt\u00ebs, por studiohet n\u00ebp\u00ebr deg\u00eb t\u00eb ndryshme t\u00eb sistemeve juridike bashk\u00ebkohore dhe n\u00eb kuad\u00ebr t\u00eb drejt\u00ebs komparative n\u00eb universitetet me renome bot\u00ebrore t\u00eb bot\u00ebs perendimore.<br \/>\nSheriati, gjat\u00eb pes\u00ebmb\u00ebdhjet\u00eb shekujve t\u00eb kaluar, ka mbijetuar shum\u00eb organizata politike dhe sisteme shoq\u00ebrore t\u00eb bashk\u00ebsis\u00eb muslimane. Ai rregullon m\u00ebnyr\u00ebn e kryeijes s\u00eb ceremonive fetare t\u00eb musliman\u00ebve, por duksh\u00ebm ka ndikuar n\u00eb struktur\u00ebn familjare t\u00eb grupeve etnike t\u00eb ndryshme t\u00eb musliman\u00ebve ka luajtur rolin e faktorit koheziv midis tyre, ka rregulluar transaksionet ekonomike, themelet e organizimit shtet\u00ebror dhe ka siguruar rregulla p\u00ebr komunikim reciprok t\u00eb tyre.<br \/>\nMaterija q\u00eb p\u00ebrfshin e drejta e sheriatit ka nj\u00eb shtrirje shum\u00eb t\u00eb gj\u00ebr\u00eb si n\u00eb aspektin kohor ashtu edhe n\u00eb at\u00eb hapsinor. Prandaj t\u00eb trajtosh e t\u00eb shkruash p\u00ebr t\u00eb drejt\u00ebn e sheriatit islam n\u00eb p\u00ebrgjith\u00ebsi apo p\u00ebr t\u00eb drejt\u00ebn penale islame n\u00eb ve\u00e7anti nuk \u00ebsht\u00eb pun\u00eb e leht\u00eb. Dihet se e drejta e sheriatit ka burimet vetanake n\u00eb baz\u00eb t\u00eb t\u00eb cilave \u00ebsht\u00eb krijuar dhe zhvilluar jurisprudenca islame (fik\u2019h), e cila p\u00ebr disa shekuj me sukses ka ofruar zgjidhje p\u00ebr nevojat imanente t\u00eb koh\u00ebs. Mir\u00ebpo, me kalimin e koh\u00ebs (n\u00eb shekullin e V hixhrij-shek. X), n\u00ebn ndikimin e shum\u00eb faktor\u00ebve, ve\u00e7mas p\u00ebr faktin se doktrina konzervative kishte proklamuar t\u00eb mbyllur dyert e ixhtihadit (me \u00e7ka praktikisht u eliminua instituti i ixhma-s\u00eb), shkenca juridike filloj t\u00eb ngec\u00eb kurse e drejta pak a shum\u00eb \u00ebsht\u00eb balsamuar n\u00eb nivelin q\u00eb e kishte kultivuar teoria juridike klasike. K\u00ebsisoj, E drejta islame, n\u00eb mas\u00eb t\u00eb konsiderueshme e kishte mbyllur fleksibilitetin dhe lidhjen midis t\u00eb drejt\u00ebs dhe shoq\u00ebris\u00eb.<br \/>\nGabimisht konsiderohej se idealet t\u00eb cilat synon t\u2019i arrij e drejta ve\u00e7 ja- n\u00eb arritur me interpretimin e teoris\u00eb juridike klasike. Realiteti \u00ebsht\u00eb se interpretimi i t\u00eb drejt\u00ebs dhe i dispozitave pozitive \u00ebsht\u00eb process dialektik dhe si i till\u00eb duhet t\u00eb ruhet po q\u00eb se d\u00ebshirohet q\u00eb e drejta t\u00eb fimksionoj\u00eb normalisht. Shnd\u00ebrrimin e idealeve n\u00eb dispozita dhe institucione konkrete.<\/p>\n<p><strong><u>El-Xhami-s-agir, pjesa e par\u00eb me p\u00ebrkthim n\u00eb gjuh\u00ebn shqipe<\/u><\/strong><\/p>\n<p>Fakti q\u00eb shkenca e hadithit, p\u00ebrmes formave dhe m\u00ebnyrave t\u00eb ndryshme \u00ebsht\u00eb m\u00ebsuar dhe kultivuar shekuj t\u00eb t\u00ebr\u00eb n\u00eb trevat tona. Forma gojore e prezantimit t\u00eb tij \u00ebsht\u00eb ajo q\u00eb ka dominuar m\u00eb tep\u00ebr por edhe format e tjera nuk kan\u00eb munguar. P\u00ebr studimin e hadithit n\u00eb Maqedoni kan\u00eb ekzistuar edhe shkolla t\u00eb ve\u00e7anta. Gj\u00eb e cila flet p\u00ebr at\u00eb se n\u00eb k\u00ebt\u00eb vend, hadithi \u00ebsht\u00eb studiuar n\u00eb m\u00ebnyr\u00eb profesionale n\u00eb nivel t\u00eb lart\u00eb. Mir\u00ebpo, studimi i tij n\u00eb gjuh\u00ebn shqipe relativisht ka filluar m\u00eb von\u00eb at\u00ebher\u00eb kur n\u00eb vend ishin themeluar medreset\u00eb dhe s\u00eb fundi edhe Fakulteti i Shkencave Islame n\u00eb Shkup. Me hapjen e k\u00ebtyre institucioneve t\u00eb larta lind nevoja e pasjes s\u00eb literatur\u00ebs q\u00eb i p\u00ebrket fush\u00ebs s\u00eb hadithit n\u00eb gjuh\u00ebn shqipe.<br \/>\nVitet e tet\u00ebdhjeta kan\u00eb sh\u00ebnuar fillin e paraqitjes s\u00eb artikujve dhe t\u00eb teksteve t\u00eb par\u00eb n\u00eb gjuh\u00ebn shqipe n\u00eb t\u00eb cil\u00ebt jan\u00eb trajtuar tema t\u00eb caktuara t\u00eb Shkenc\u00ebs s\u00eb hadithit. Mungesa e skajshme e literatur\u00ebs s\u00eb k\u00ebsaj shkence n\u00eb k\u00ebt\u00eb gjuh\u00eb dhe nevoja e nx\u00ebn\u00ebsve dhe e student\u00ebve p\u00ebr k\u00ebt\u00eb lloj literature, i ka motivuar studiuesit shqiptar q\u00eb t&#8217;i rrek\u00ebn pun\u00ebs p\u00ebr t\u00eb hartuar tekste dhe p\u00ebrkthimin e veprave baz\u00eb nga gjuha arabe n\u00eb gjuh\u00ebn shqipe. Pasi q\u00eb veprat kapitale t\u00eb hadithit kishin filluar t\u00eb p\u00ebrkthehen si\u00e7 \u00ebsht\u00eb Sahihu i Buhariut, Sahihu i Muslimit, Suneni i Ebu Davudit, Suneni i Tirmidhiut, Mu- vettai i Malikut. Sipas informatave Suneni i Ebu Davudit dhe Suneni i Tirmidhiut t\u00ebr\u00ebsisht jan\u00eb p\u00ebrkthyer n\u00eb gjuh\u00ebn shqipe. Sahihu i Buhariut dhe i Muslimit jan\u00eb n\u00eb p\u00ebrfundim e sip\u00ebr. Pjesa e par\u00eb e Muvettait t\u00eb imam Malikut tani m\u00eb ka dal\u00eb nga shtypi i p\u00ebrkthyer n\u00eb gjuh\u00ebn shqipe. Q\u00eb do t\u00eb thot\u00eb se p\u00ebrve\u00e7 Sunenit t\u00eb Nisaiut t\u00eb gjitha p\u00ebrmbledhjet e tjera pothuajse po p\u00ebrkthehen n\u00eb k\u00ebt\u00eb gjuh\u00eb.
